How long does it take to finalize a divorce in California? By law, a divorce cannot be finalized until at least six months and one day after the initial papers are served. However, complex cases involving property or contested custody often take longer.
What is the difference between Legal and Physical custody?Legal custody gives you the right to make major decisions (schooling, medical care, religion). Physical custody refers to where the child actually lives. Both can be "joint" or "sole" depending on the child's best interests.
Can my child choose which parent they want to live with? In California, there is no "magic age" where a child chooses. However, if a child is 14 or older, the court must let them address the judge directly if they wish, though the judge still makes the final decision based on their overall well-being.
How is "Alimony" (Spousal Support) calculated? For temporary support, courts often use a formula. For permanent support, judges look at many factors, including the length of the marriage, each spouse’s earning capacity, and the standard of living during the marriage.
What happens if my ex-spouse violates a court order? If an order for custody, visitation, or support is being ignored, you can file a "Contempt of Court" or a "Request for Order" to enforce the existing rules. We help clients navigate these enforcement actions to ensure their rights are protected.
"Mr. Quiles is an experienced and skilled professional who strives to accomplish the best results for his clients. I have personally known Richard to be a skilled trial advocate who has won “un-winnable” cases. I would recommend him to anyone who needs assistance in family law litigation cases"
"Richard was the 3rd attorney I have had to represent me in an 8 year period through the Family Law court. His approach to this challenge was a complete 180 from what was previously used and failed. Facing an uphill battle with the deck seemingly stacked against us, his methodical method of maneuvering though a huge pile of …well you know…he was able to overcome and do something my last two attorneys were not able to accomplish. I will and forever highly recommend this attorney to anyone going though Family Law matters."
"I met with Richard for an initial consultation to discuss options regarding my child custody case. I was concerned that I had made several mistakes by attempting to handle the matter on my own, but Richard quickly put my mind at ease. He clearly outlined several practical options to get the case back on track and provided a realistic assessment of my current situation. Richard was completely honest and transparent and those are qualities that seem uncommon in the legal field today. He was straightforward, knowledgeable, and professional throughout our discussion. I left the consultation with a renewed sense of confidence and a clear plan of action. I will absolutely be retaining Richard for all of my future Family Court matters. His integrity, expertise, and direct approach are truly appreciated."
